"Customer" means the person, firm or company applied a registration form and made payment after
trial period to use services provided by http://www.general.aero/.
"GTA" shall mean this General Terms of Agreement including Attachments hereto.
"Software" means the Object Code and accompanying documentation and support files; the software
functionality is described in Exhibit A, including Updates (if any).
"Modifications" means any addition to or deletion from the substance or structure of either the
Original Code or any previous Modifications. When Object Code is released as a series of files,
a
Modification is: (i) any addition to or deletion from the contents of a file containing Original
Code or previous Modifications; (ii) any new file that contains any part of the Original Code,
or
previous Modifications.
"Updates" means any patches, bug fixes, upgrades, and new versions of the Software made
generally
available by Contractor during the term of this GTA.
"Defect" is any failure by the Software to conform in any material respect with the Software
Specifications detailed in Exhibit A.
SUBJECT OF THE GTA
This GTA specifies all the services that Contractor provides to Customer including delivery of
Software as defined in the in Exhibit A and Support Services.
Services hereunder are aimed at enabling the functioning and interaction of all Software Modules
and programs during the entire services period.
DURATION
This GTA enters into force when Customer applied a registration form and valid for the period
for which the Customer has made payment.
Access to the site will be closed automatically if the debt exceeds one month.
Access to the site will be restored automatically if the debt is repaid. Number of successive
automatic extensions of the term of the Agreement is not restricted.
CONTRACTOR GRANTS
Subject to Customer’s payment for the Software Utilization and the other terms and conditions hereof,
Contractor grants Customer an unlimited, non-exclusive, non-transferable right to:
After the trial period Customer has to pay monthly fee for the Software Utilization and Technical
Support. Monthly fee is 30 Euro.
REFUNDS
We don not refund money for our service.
SOFTWARE PLATFORM
The web-based Software is tested and accepted to use on the Google Chrome and the Firefox browsers.
TRAINING
If Customer wants Contractor will provide the training courses remotely by using Skype facilities, it is
free of charge for the first two (2) hours and then a fee of 20 EUR per hour is charged.
REPAIR AND SUPPORT SERVICES
Beginning on the date of Acceptance, Contractor shall provide the following free of charge Software
support services:
Use its best efforts to confirm the existence of and correct errors in the Software if Customer
notifies Contractor that such errors exist;
Provide Customer with updates necessary for the Software to continue operation on different
hardware platform;
Provide Customer with updates including enhancements, additional features as they are
incorporated into the Software, and modifications necessary for state, or aviation authority
requirements.
COMPLAINTS
Any complaints about Software Utilization may be sent to our support team: support@alaskartech.com or (372) 55-14-204.
MODIFICATIONS
The Contractor has the right to make changes, improvements and add new features to the system without
notifying Customers.
LIMITATION OF LIABILITY
Contractor shall have no responsibility for the consequences of:
Default or negligence on behalf of the Customer;
Incorrect use of systems on behalf of the Customer;
Computer viruses inflicted by others than Contractor;
Changes to the IT-environment that is covered by the operational services as set forth in the
individual System Attachments made by the Customer;
Failure to comply with Contractor reasonable advice.
CONFIDENTIALITY
Both parties shall maintain strict confidence and shall not disclose to any third party any information
or material relating to the other or the other’s business which comes into that party’s possession and
shall not use such information and material without written permission by the other party.
INTELLECTUAL PROPERTY RIGHTS
Any and all intellectual property rights in and to the Source Code and documentation for Software listed
in the Exhibit A, vest and will remain vested in Contractor. Customer has unlimited rights of use to
Software Modules listed in Exhibit A for fulfillment of intended Customer operations for indefinite
period of time.
EXHIBIT A
The General Aviation (GA) WEB-Site consists of six (6) modules:
The ‘Owners’ module is used to register aircraft owners;
The ‘Aircraft’ module - to register aircrafts, engines and propellers data;
The ‘Journey Log’ module - to register aircraft utilization: total and the last flight cycles and hours;
The ‘Maintenance Management’ module - to register technical tasks and generates an aircraft maintenance plan;
The ‘Work Package’ module provides an ability to add several technical tasks into a work package for its further completion;
The ‘AD/SB’ module is used to register and track status of aircraft's modifications.
